Terms of Use

The terms on which you may use our website and book our walking tours.

1. Definitions

1.1 “Company”, “we”, “us”, “our” means Abbey Creed Tours Ltd, a company registered in England & Wales (company number to be inserted at registration), with its registered office at 42 Vincent Square, London SW1P 2NB, United Kingdom.

1.2 “Service” means our website at abbey-creed.com and the guided walking tours we operate in London.

1.3 “User”, “you”, “your” means any visitor to the Service or any person who books or participates in a walking tour with us.

1.4 “Walker” means a User who has booked or participates in a walking tour.

1.5 “Content” means all written, photographic, audio, video and graphical materials made available through the Service by us.

2. Acceptance of Terms

2.1 By using the Service or by booking a walking tour with us, you confirm that you have read, understood and accepted these Terms of Use, our Privacy Policy, and our Cookie Policy.

2.2 You must be at least 18 years old to make a booking. Walkers under 18 may participate in a walk only when accompanied by a paying adult. Walkers under 12 are not accepted on our published walks.

2.3 If you do not agree to these Terms, please do not use the Service or book a walking tour with us.

3. Description of Service

3.1 We operate guided walking tours through public streets in central London. Our tours pause outside historic and religious buildings; we do not enter any of the buildings discussed during a tour, and a booking does not include admission to the interior of any building.

3.2 Tours run for approximately three hours and follow the routes described on the Service. We reserve the right to vary a route on the day for reasons of safety, weather or street access.

3.3 The Service is provided on an “as available” basis. Specific tour dates, times and guides are subject to availability and confirmation by us.

4. Bookings, Payments & Cancellations

4.1 Bookings are made by enquiry. After we confirm availability and you accept our quote, payment is due in accordance with the schedule communicated at the time of booking.

4.2 Walkers in the United Kingdom enjoy the consumer rights set out in the Consumer Rights Act 2015 and (where applicable) the Consumer Contracts Regulations 2013. Nothing in these Terms limits those rights.

4.3 Cancellation by you: a full refund is available up to 14 days before the start of the walk. A 50% refund is available between 14 days and 72 hours before the start of the walk. After that, refunds are not available, but we will reschedule once at no charge subject to availability.

4.4 Cancellation by us: we may cancel a walk for severe weather, public-safety reasons, or guide unavailability. In that event we will offer a full refund or a free reschedule, at your election.

5. User Conduct

5.1 During a walk, you agree to follow the reasonable instructions of your guide regarding safety, route, and conduct.

5.2 You agree not to (a) behave in a manner likely to cause distress to other walkers, members of the public, or persons engaged in worship; (b) consume alcohol or controlled substances during the walk; (c) photograph other walkers without their consent.

5.3 We reserve the right to remove from a walk any walker whose behaviour we, in our reasonable judgement, consider unsafe or seriously disruptive. No refund is due in such cases.

6. Intellectual Property

6.1 All Content on the Service is owned by us or our licensors and is protected by United Kingdom and international copyright law.

6.2 You may view and print pages of the Service for personal, non-commercial use. Any other use, including reproduction, transmission or commercial exploitation, requires our prior written consent.

7. Termination

7.1 We may suspend or terminate your access to the Service at any time without notice if you breach these Terms.

7.2 Termination does not affect any rights or obligations accrued before the date of termination, including obligations to pay or refund.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED ON IT. NOTHING IN THIS CLAUSE LIMITS OR EXCLUDES ANY STATUTORY WARRANTIES OR RIGHTS THAT CANNOT BE LIMITED OR EXCLUDED UNDER ENGLISH LAW, INCLUDING WITHOUT LIMITATION THE CONSUMER RIGHTS ACT 2015.

9. LIMITATION OF LIABILITY

NOTHING IN THESE TERMS LIMITS OR EXCLUDES OUR LIABILITY FOR (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER ENGLISH LAW. SUBJECT TO THIS, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH A WALKING TOUR SHALL NOT EXCEED THE FEE PAID BY YOU FOR THAT TOUR. WE SHALL NOT BE LIABLE FOR ANY LOSS THAT WAS NOT FORESEEABLE TO BOTH PARTIES AT THE TIME THE CONTRACT WAS MADE.

10. Insurance

10.1 We hold public liability insurance with Hiscox to a limit of £5,000,000 per occurrence. A copy of the certificate is available on request to bookings@abbey-creed.com.

11. Severability

11.1 If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

12. Changes to Terms

12.1 We may update these Terms from time to time. The current version will always be available on this page, with the version number and Last Updated date shown above. Your continued use of the Service after a change constitutes acceptance of the updated Terms.

13. Governing Law & Disputes

13.1 These Terms and any dispute arising out of or in connection with them are governed by the laws of England & Wales.

13.2 The courts of England & Wales have exclusive jurisdiction over any dispute, except that consumers resident in Scotland or Northern Ireland may also bring proceedings in their local jurisdiction as provided by law.
